Terms of Use

This Terms of Use Agreement (this “Agreement”) governs your access to and use of Heart Maps® for Teachers Tool Kit Annual Subscription owned and/or operated by Georgia Heard including any products, content, functionality and services offered on or through the Site HeartMaps.com (the “Service”).

By using the Site, clicking “Subscribe to Heart Maps® Toolkit for Teachers now” or similar, registering, accessing or using this Service, you agree to be bound by this Agreement, and agree to all of the terms, conditions, and notices contained or referenced herein.

You represent that you are of legal age to form a binding contract with Georgia Heard and are not barred under any applicable laws from doing so. If you are using the Site or subscribing to any Service on behalf of an organization, you represent and warrant that you have the authority to bind the organization to this Agreement, in which case the term “you” shall refer to both you and the organization.

If you do not agree to these requirements, do not click “Sign Up” (or similar) and do not access the Site or otherwise use the Service.

1 Subscriptions

The subscription portion of the Site is for subscribers only. To obtain access you are required to register and become a subscriber. Subscriber fees apply.

When you register to become a subscriber, you will create an ID and password. You must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to the Site or portions of it using your ID or password. You agree to notify me immediately of any unauthorized access to or use of your ID or password or any other breach of security. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

I have the right to disable any ID, password or other identifier at any time.

2 Fees and Payment

If you buy a subscription, you agree to pay the applicable fee for the Service. Also, you agree that:

Unless otherwise specifically stated, all prices shown on the Site are in U.S. Dollars and all amounts owed must be paid in U.S. Dollars.

The Service, Heart Maps® for Teachers annual subscription, runs for 12 months from September 2022 through August 2023. Each subscriber will have access to the Heart Map materials on the Site posted from September 2022 through August 2023 — no matter when you sign up. The Service, Heart Maps for Teachers annual subscription, will automatically renew on August 15, 2023, for the 2023-2024 school year (September 2023 – August 2024) with new Heart Maps and materials available monthly.

I do not offer cancellations as the Service, Heart Maps for Teachers annual subscription, grants access to Heart Map materials from previous months starting September 2022 – August 2023. However, you can terminate your automatic renewal for the 2023-2024 school year by writing to [email protected]

For renewing subscriptions, I may store and continue billing your payment method (e.g., credit card) even after it has expired, to avoid interruptions in your Service. To avoid future charges, cancel before the renewal date by notifying me at [email protected]. No amounts that have been paid for the services is refundable.

3 Availability

You are responsible for (i) making all arrangements necessary for you to have access to the Site (e.g., providing your own equipment and internet connection and paying any internet access fees) and (ii) ensuring that all persons who access the Site through your internet connection are aware of the terms and conditions of this Agreement and comply with them.

4 Cancellations

I do not offer cancellations as the Service, Heart Maps for Teachers annual subscription, grants access to Heart Map materials from previous months starting September 2022 through August 2023. However, you can terminate your automatic renewal for the 2023-2024 school year by writing to [email protected]

5 Your License to Heart Maps for Teachers Annual Subscription

When you register for the Service, you may be asked to provide certain content or information.

You agree that I may access, store and use any information that you provide in accordance with the terms of the Privacy Policy and this Agreement.

6 Intellectual Property Rights

The Site and Service are owned by Georgia Heard and Heart Maps® are protected by United States and international copyright and trademark, patent, trade secret and other intellectual property or proprietary rights laws.

This Agreement permits you to use the Site for your own personal and organizational purposes only. You are granted a limited, non-transferable, revocable license to use the Site, subject to the terms and conditions of this Agreement and in compliance with all applicable laws, rules and regulations and any agreements or terms with third parties to which you are subject. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Site, except as follows:

You may print or download a reasonable number of pages of the materials I provide you access, downloadable documents on the Site, for your own personal and professional use and not for further reproduction, publication or distribution.
You may download and print documents from the Site and you may share complete printed copies of such documents for classroom use, in local staff development settings with an attendance of no more than forty individuals, where no fee is charged for participation.
You are granted a limited, revocable (for any reason or no reason), and nonexclusive right to create a hyperlink(s) to the home page(s) of the Site so long as the link does not portray me or the Site or Service in a false, misleading, derogatory, or otherwise offensive matter.

You must not:

Modify copies of any materials obtained from the Site.
Delete or alter any copyright, trademark or other proprietary rights notices from copies of materials from the Site.
You may not link to the Site from any web site that is unlawful, abusive, indecent or obscene, that promotes violence or illegal acts or that is otherwise inappropriate in Georgia Heard’s sole discretion.
Access or use any part of the Site other than for purposes of receiving the Service.

If you wish to make any use of material on the Site other than as set out in this section, please address your request to [email protected].

No right, title or interest in or to the Site or Service, or any portion thereof, is transferred to you, and all rights not expressly granted are reserved by Georgia Heard. Any use of the Site or Service not expressly permitted by this Agreement is a breach of this Agreement and may violate copyright, trademark and other laws.

7 Trademarks

Heart Maps® name and logo, product, service, and design contained on the Site are trademarks of Georgia Heard, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Georgia Heard. You may not use any meta tags or any other “hidden text” utilizing my name or trademark without my express written consent.

8 Permitted and Prohibited Uses

You may use the Site and Service only for lawful purposes and in accordance with this Agreement. You agree not to use the Site and Service in any way that violates any applicable federal, state, local or international law or regulation.

You also agree not to:

Use the Site or Service in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Service. Use any robot, spider or other automatic device, process or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
Use any device, software or routine that interferes with the proper working of the Site.

Introduce any viruses, Trojan horses, worms, logic bombs or other material which is malicious or technologically harmful.
Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Site or Service, the server on which the Site is hosted, or any server, computer or database connected to the Site.
Attack the Site via a denial-of-service attack or a distributed denial-of service attack.
Attempt to bypass methods Georgia Heard may use to prevent or restrict access to the Site or Service.
Otherwise attempt to interfere with the proper working of the Site.

9 Reliance on the Sites

Any informational materials provided on the Site, are not intended to substitute for any professional educational, medical, legal, psychiatric, employment or other advice. Georgia Heard will not be responsible or liable for the accuracy, usefulness or availability of any information on the Site. Georgia Heard disclaims any and all liability for any loss, damage or injury based on information directly or indirectly obtained through the Site.

10 Disclaimer of Warranties

You understand that I cannot and do not guarantee or warrant that content available via the Site will be free of viruses or other destructive code. You are responsible for implementing procedures to satisfy your particular requirements for anti-virus protection. I will not be liable for any loss or damage caused by a virus or technologically harmful material due to your downloading any material posted on the site

11 Governing Law

Any claim relating to this website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.
